This case pertains to two provisions under one law, one of which criminalizes possession or use of a firearm during a federal crime of violence or drug trafficking crime, the other which lays out penalties for that crime including capital punishment when violation results in death. This brings into question whether or not each provision can yield a conviction, totaling to two convictions, or only one together.

The majority Opinion of the Supreme Court was that Congress intended the later provision to be an alternative so only one conviction may be yielded.
